Terms of Use

These Terms of Use (“Terms”) govern your use of Olive Shoots, provided by Appstackly LLC (“we”, “us”, or “our”). By creating an account or using Olive Shoots, you agree to these Terms. If you don’t agree, please don’t use the service.

1. Eligibility and accounts

You must be at least 18 years old (or the age of majority where you live) to create an account. You are responsible for your account, for keeping your sign-in credentials secure, and for the family members and child profiles you create and manage. You are responsible for activity that happens under your account.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Olive Shoots for your family’s personal, non-commercial use, in accordance with these Terms.

3. Purchases and refunds

Olive Shoots is a one-time purchase of $49.99 USD that covers your whole family — there is no subscription. We offer a 14-day money-back guarantee: if Olive Shoots isn’t right for you, email support@appstackly.com within 14 days of purchase for a full refund. Purchases made through the Apple App Store or Google Play are also subject to that store’s terms and refund policies. Prices and availability may change.

4. Acceptable use

You agree not to:

• Use Olive Shoots for any unlawful purpose or in violation of these Terms.
• Interfere with, disrupt, or attempt to gain unauthorized access to the service.
• Reverse engineer, decompile, or attempt to extract source code, except where that restriction is prohibited by law.
• Upload content you don’t have the right to use, or that infringes others’ rights.

5. Your content and family data

You retain ownership of the content you create in Olive Shoots, including events, photos, and other family data. You grant us a limited license to store, process, and display that content solely to operate the service for you. You are responsible for your content and for having the rights to any photos or material you upload.

6. Intellectual property

Olive Shoots, including its software, design, and trademarks, is owned by Appstackly LLC and protected by law. These Terms do not transfer any of our intellectual property to you.

7. Third-party services

Olive Shoots relies on third-party services such as Google Firebase, Apple and Google sign-in, and (when available) Stripe for payments. Your use of those features may be subject to the third party’s terms.

8. Disclaimers

Olive Shoots is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, timely, secure, or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Appstackly LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits. Our total liability for any claim relating to Olive Shoots will not exceed the amount you paid for it.

10. Indemnification

You agree to indemnify and hold Appstackly LLC harmless from any claims or expenses arising out of your misuse of Olive Shoots or your violation of these Terms.

11. Termination

We may suspend or terminate access if you violate these Terms. You may stop using Olive Shoots and delete your account at any time.

12. Governing law

These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Utah for any dispute arising out of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. If you continue to use Olive Shoots after we post changes, you accept the updated Terms.
